When a facility asks whether it needs a Title V permit, the answer depends on one number: potential-to-emit. Get that number right and the permit category follows. Get it wrong and the consequences range from unpermitted construction to significant enforcement exposure.

What makes a source major

Under the Clean Air Act, a major stationary source is one with potential-to-emit at or above a defined threshold for one or more regulated pollutants. For most pollutants in most attainment areas, that threshold is 100 tons per year. For certain pollutants and certain area types, lower thresholds apply.

The critical word is potential, not actual. Potential-to-emit is the maximum capacity of a source to emit a pollutant, assuming it operates at maximum rated capacity 24 hours per day, 365 days per year, with no emission controls. A facility that runs at 30 percent capacity and emits 40 tons per year may still have a potential-to-emit of 200 tons per year if it could theoretically operate continuously at full output.

How potential-to-emit is calculated

The calculation starts with the emission unit: what is the maximum rate at which it can emit a given pollutant, expressed as a mass rate per unit of operation? For a combustion unit, that might be pounds of NOx per MMBtu of heat input. For a coating line, it might be pounds of VOC per gallon of coating applied.

Multiply the emission rate by the maximum operating capacity and the number of operating hours in a year and you have the uncontrolled potential-to-emit. If control equipment is in place and its efficiency is federally enforceable, the controlled potential-to-emit accounts for the control device efficiency.

Federally enforceable limits matter: A facility can reduce its potential-to-emit below the major source threshold by accepting federally enforceable limits on hours of operation or production throughput. These limits must be in a permit or other federally enforceable mechanism. An informal agreement or a facility policy does not count.

The synthetic minor: staying below the threshold by choice

A synthetic minor source is one that has the physical capacity to emit above the major source threshold but has accepted federally enforceable limits to keep its potential-to-emit below that threshold. This is a deliberate regulatory strategy and it is common.

A facility might accept a 500-hour-per-year operating cap on a generator that would otherwise push it above the 100-ton threshold. As long as that cap is in a permit and the facility complies with it, the facility remains a minor source. The moment the facility exceeds the cap, it is operating as a major source without a major source permit. The exposure at that point is significant.

Synthetic minor compliance is not passive: Operating under a synthetic minor designation requires active tracking of production rates, hours of operation, and material consumption against the permit limits that define the synthetic minor status. Exceeding those limits without a permit modification is an unpermitted exceedance of major source applicability, not just a permit deviation.

Title V: what the permit actually requires

Once a facility is classified as a major source, it must obtain a Title V operating permit. Title V consolidates all applicable requirements into one permit document and creates a comprehensive compliance certification obligation. The key features of a Title V permit that distinguish it from a minor source permit include:

Minor source: what you still have to manage

A minor source permit is simpler than Title V, but simpler does not mean unmanaged. Minor source facilities still have applicable federal requirements, still have state permit conditions, and still have monitoring and recordkeeping obligations. The compliance burden is lower, but the obligation to track it is the same.

The practical difference for EHS managers is the reporting frequency and the certification requirement. Minor source facilities typically report annually or upon deviation rather than semi-annually, and the compliance certification obligation is less formal than the Title V Responsible Official signature requirement.

Where facilities get into trouble

The most common compliance problems at the Title V vs minor source boundary involve one of three things:

Miscalculating potential-to-emit.
